Take used car to India

Q: Dear Sir,
I want to settle in India. I have a Ford Car 2006 model 2.0 L with me. I was using this for the past 3 years. What will be the customs charges for the car to take to India.

A: The rate of duty works out to around 181% on cars. You should be able to claim depreciation on the used car to determine value.

Unless things have changed the depreciation allowed is For every quarter during 1st year 4%. For every quarter during 2nd year 3%  and for every quarter during 3rd year 2.5%

Take Motor Bike to India on Transfer of Residency

Q: Sir,

I purchased a Harley Davidson Bike – Softail Heritage Classic – 1584CC during June 2008 and wish to take it to India by end of this year. The Bike is in Qatar where I am employed and will be taking it on TR. Please advise the rate of Customs I will have to pay and also advise if you know some clearing agent at the JNPT – Mumbai for the customs clearance.

A: Transfer of residency is allowed only after a stay of at least two years abroad. So make sure you meet the residency requirements.

Unless rules have changed the duty is around 120%.

I am unable to recommend any customs clearance agent in Mumbai. Customs brokers all over the world have affiliates who handle their work at different ports. Check the advertisements for customs brokers and shop around for someone you are comfortable with. There is also the option of having friends or family members in Mumbai contact a local broker on your behalf.

A: I don't think there is anything such as zero duty for NRIs. Unless NRIs transfer residence to India they can't send back cars to India.

ICICI Bank Reputation

Q: hello how are you. i want open my nri account in icici bank. i never come to India long time. this bank reputation is good or not. i need to prove my USA income when i deposit the money in my Indian bank.

A: ICICI bank has branches in USA and Canada also. I had an account with them in Canada that I closed and am not a fan of this bank. Do a search on the internet for problems with ICICI bank and then decide for yourself.

When you deposit money in banks located in the United States amounts over $10,000 require reporting to the tax authorities. Banks who suspect illegal source of funds are legally bound to report such transactions to authorities.

 

Take Furniture to India

I am a PIO card holder and own a flat in Mumbai. I would like to ship to Mumbai, some of my used household goods (furniture & appliances) to furnish this flat, since my family will be staying in it every time we visit India. I have purchase receipts for most of the goods. Would I be charged customs for used goods (from 3 - 10 years old) ? If yes, how do the Indian customs calculate how much duty I should be
charged? Any other relevant information would be greatly appreciated.

A: Since you are not taking advantage of a transfer of residency the items you wish to take will require payment of customs duty (approx 35%)The value of the original price is reduced by yearly depreciation.

You will need a forwarder for sending your furniture and they will surely be able to tell you the exact duty. There are many aspects used to classify items for calculating customs duty. A good customs broker can save you a lot of problems and help classify the imported items at the lowest applicable rate saving you money.

Personally I would suggest you check out the prices of goods in India. The prices and quality of furniture in India is quite reasonable when compared to prices abroad.

Furthermore while old furniture may be appropriate, taking old appliances to India may eventually lead to maintenance problems due to unavailability of parts. Just a suggestion.

 

 

Booking Nano Car without Pan CardTata Nano Car

 

Q: Dear Sir,
I want book a newly launched NANO CAR online through their website, and amount will be paid through online from my NRE Account with State Bank of Travancore will be 100,000 INR.

But it is required PAN card to by a car since I have an NRI status and amount will be paid from my NRE account, I do not have such card since I am working in abroad by limited salary, can I buy without PAN card.

A: In the absence of a Pan Card you need to submit 'Form 60' which is a declaration to be filed by a person who does not have a permanent account number. Here is a sample of Form 60.

Indian Life Insurance Policies of NRIs living abroad

Q: HI,
I am an NRI in AUSTRALIA, planning to apply for Australian citizenship and then OCI.

Back home, I have few LIC policies as an INDIAN CITIZEN.

Can you please advice me , when I will be converted from INDIAN CITIZEN to OCI , will any way my insurance policies will be effected?
Eg: in case of death, will my nominee be able to get the SUM ASSURED amount?

A: Existing polices taken while in India should continue in Indian Currency even after your moving to foreign countries as NRI. However you should keep the concerned servicing branch of LIC informed about your new status and address.

LIC actually has a questionnaire form specifically for this purpose. I am posting a link to the LIC Form here. In case the form link does not work let me know and I will email it to you. Any other concerns you may have  should be sent in writing to LIC for clarification so as to remove any doubts in your mind.

I hear LIC is a pretty reputable concern and they should respond. It may be worthwhile to send letters and documentation to them by registered mail just as a matter of good record keeping and proof if required later.

Start Business in India

I have a question to ask as follows. i live in usa in long time. i have usa citizen and oci card. i want settle in India. can i registered the company in my name and open the business account in India. i want invest in real estate and open my online stock trading company in India. i need anybody permission to open my all business in India. which business i can not open in India. i have hotel business in usa. i want sell after five year. so can i open the business in India and pay the tax to different government.

Tax Treaty between India and United States of America

A: 1. You can register a company in your name in India. 2. You can open business account in India 3. You can invest in real estate.

The only permission you need is to follow the normal business registration process applicable to open a new business in India. A good accountant should be able to guide you.

Stock trading involves meeting many financial and administrative regulations, answers to which are beyond the scope of this forum. Contact a professional accountant or lawyer for advice.

Since you state that you are presently in the hotel business in the USA you may want to consider this line of business in India. There is a tremendous shortage of good hotels in India. Hotel business in India can be very profitable.

A: If you settle in India you will pay taxes in India. United States and India have a tax treaty so that their citizens avoid double taxation. When US citizens pay income tax by filling tax returns in foreign countries with whom the United States has tax treaties, they are given a foreign tax credit when filling their US tax return so as to avoid double taxation. Where you earn income and the amount of time you spend in India are two factors that come into play. Check with an accountant for professional tax advice.

Hi, I am a permanent resident of Australia and am planning to move to India for good to work with my father in his company. I have just bought a AUDI Q7 about 2 weeks ago and wish to take it back to India with me. Will I need to pay any custom duty since it is a transfer of residency?
