Pan Card Paid For but Not Received
 

Q. Dear Sir, I am writing on behalf of Anita Cord since she doesn’t have a mail id.

She had applied for PAN card online & requested for the delivery of the card in Kuwait for which she has paid necessary amount Rs. 771/- The PAN Application status shows that the card has been dispatched on 13th March 2008, however the same has not been received by her till date.

Can we know how the cards are sent –whether courier, registered post or ordinary post?

A. Please note that this website is not associated with the Government of India in any way. I have lived abroad for 37 years and started this website after retiring as a hobby and my way of helping people with Nri related and immigration issues.

The fee for processing PAN application is Rs.717.00[Application fee Rs.67 (Rs.60.00 + 12.24% service tax) + Dispatch Charges Rs. 650.00]. So I would assume that the tax department in India will not send out Pan Cards abroad by ordinary post as they charge Rs.650 for mailing cost.

I can give you two suggestions:

1. Check to see if you provided the correct address on your application when you applied for the Pan Card. Problems with misspelled words or wrong pin numbers can result in non delivery sometimes.

2. You should contact the tax department in India and let them know that you have not received your Pan Card.

OCI 'U' Visa on expired passport 

Q. Dear Sir/Madam,
My family wishes to travel to India from US during this month. We all have OCI cards. During this past year my daughter had to renew her US passport. She has the 'U' visa which is also the life-long visa for India on her old US passport. I hear that to transfer that visa to her new passport will take more than a month and hence it is too long a time for me to do that. Will she be allowed entry into India if I carry her old passport (with the U visa) and the new passport along with her OCI booklet ?

A. As long as your daughter carries her old passport wherein the OCI ‘U’ visa sticker was pasted along with new passport there should be no problem.

Setting up a factory in India - Where to get Information?

 


Q. Hi there
I was wondering if you had any information about setting up a social enterprise in India. I am considering setting up a business (factory) in a disadvantaged part of India. I would like the principle aim of this business to be about providing opportunities to local people may be struggling to support their families. I would like to employ disadvantaged women and in addition to their wages, I would like the business to provide funding for their children’s education. This will be a partly commercial initiative, as I am hoping that the finished items made in the factory can be sold in the West for profit. Most of this profit will be ploughed back into the organization in order to fulfill its aims.

I noticed on your website that there are incentives for businesses hoping to set up in ‘backward areas’. This would be very beneficial for this organization. Do you know about any of the official procedures I would need to engage in to set up my proposed enterprise? It may be necessary that I set up the social enterprise in England under UK laws and set up an associate factory in India under IndiaR17;s tax laws.

A. Your idea of setting up a factory in a disadvantaged part of India is very commendable. While the ultimate aim of most business ventures is profit, I find some compassion in the wording of your email. I sincerely hope you pursue your project and make a success of it.

Every State Government in India offers advantages for setting up factories in their state. Selecting backward areas, has added financial advantages such as cheaper land or shed costs, tax holidays for a number of years, lower electricity charges, subsidized loan rates etc.

As a start you can check out the Ministry of Commerce & Industry website. This websites is supposed to provide information to investors about investment policies and procedures in India. Press releases related to investment policies are also on this website. They also have a chat facility which you may want to try if you need additional information. However this website in my opinion is not laid out very well and it takes time going around trying to find information. If you have an idea which part of India you would like to setup in, then you should check out the State Government website as some states have slightly better laid out websites than the Ministry of Commerce and Industry website.

Registration Requirement for stay exceeding 180 days in India

Q. Please clarify if my employment exceeds 180 days in India, should I register with FRRO/FRO and is it one-time registration? Thanks, Suresh

A. Yes, if your stay is going to be over 180 days you should register. This is a simple procedure and a one time requirement. There is no fee for registration as long as you register before you complete 180 days in India. Keep your copy of registration safely, as you will need it when you leave India.

You need to fill out the required registration form and provide the following documentation:

When filling in your registration form tick off multiple entry. In this way if you have to leave India for a short trip and return you will not have to register again.


 
Can PIO Holder work in India

Q. Hi, Recently I came across this site and it is very informative. You are doing a great service by providing valuable information free of cost.
I am born Indian and got Citizenship of another country in SE Asia and holding PIO, I want to know whether I can work in India now with PIO or does the company need to apply a work visa for me. How long can I stay in India with PIO? Regards Suresh

A. PIO Card holders can work in India and do not need a employment visa for most types of work in the private sector. You cannot work for the Government and for some special types of work such as, research work or missionary activities. Check details with your nearest Indian consulate or if in India from the FRRO.

PIO cards have a validity of 15 years from the date of issue. However your foreign passport must also be valid during your stay in India.

The length of time you can stay in India will depend on the validity of your passport and the PIO card.

Of course if you are in India and if any of the above documents are going to expire you probably would have the option of renewing them in India, as long as you do it before their expiry date. After seven years in India PIO card holders, if they choose can apply for Citizenship of India.
