Surrender Indian Passport Fee

Q: hi i am kailasben i just want to know that if my passport is expired on November 3rd 2001 do i still need to pay penalty because i read that if your passport is expired before 31st December there is no penalty.

A: Passport surrender fee is not based on when your Indian passport expired but when you acquired foreign citizenship.

Simple clarification:
  1. For those who acquired foreign citizenship on or before May 31, 2010 and have a 'cancelled' stamp on your passport, then there is no fee requirement as no further action is required.

  2. Those who acquired foreign citizenship on or before May 31, 2010 and do NOT have a 'cancelled' stamp on their old Indian passports, then they require a 'Surrender certificate' for which the fee is only US$20/

  3. Those who acquired foreign citizenship on or after June 1, 2010 are required to pay the full fee of US$175/ to get 'Renunciation & Surrender Certificate'

Assuming that you got foreign citizenship before May 31, 2010 and your old Indian passport has a 'Cancel' stamp then you need not pay any fee. However if you do not have the 'Cancel' stamp then you need to pay $20 to get a Surrender certificate.

Pan Card for Foreigners - How to apply for Pan Card

Q: Could you please advise me how to apply for a PAN card for a person with Irish Passport, holding PIO card and residing in UK.

Mathew

A: Foreign Citizen located outside India at the time of application for PAN are also required to provide proof of identity and proof of address.

For proof of identity the guideline is to provide:

  1. Copy of passport

  2. Copy of other National ID attested by Indian Embassy/Consulate/High Commission

  3. Copy of Person of Indian Origin(PIO)card issued by Government of India

For proof of address your best bet is to get a copy of any National ID attested by Indian Embassy/Consulate/High Commission or a copy of bank account statement from your bank in UK attested by Indian Embassy/High Commission/Consulate.

Import car to India under transfer of residency

Q: Dear Mr.Chand,

My name is Subha Rao, working in Dubai for Mitsubishi Motors dealer from last 11 years, I bought one Lancer, 1500CC, 1999 MODEL, Automatic Transmission from Dubai. I wish to import to India, somebody said we cant import 1999 model cars in India, please advice me, can i import it under TR rules, and how much I have to pay as customs duty (or penalty).

Thanks in Advance

Waiting for your response.

S.Rao

A: There is no penalty for import of car to India if you are doing this under transfer of residency. Actually car can only be imported if you are transferring residence into India. I believe the rule as per Motor Vehicle Act, 1988 where in cars older than three years old cannot be imported to India does not apply in cases of Transfer of Residency. You should check with a customs broker to get you the exact customs duty breakdown. You can also check HERE for more information duty calculation and HERE for information on car imports by NRIs

Dual taxation

Q: My Bro is a Canadian Citizen. He & his Family (i.e. Wife & 2 Kids) have surrendered there Indian Citizenship & he also has a Child born after he emigrated to Canada.

He says if he takes up Dual Citizenship, regardless of his Income in India he still will have to pay taxes here.

Which means he ends paying taxes in 2 countries for his income in Canada. Does it Work That way?

Does he have to renew his Dual Citizenship Yearly?

A: For his income in Canada your brother does not have to pay any taxes in India. Dual taxation treaties exist between Canada and India. As for your second question, India does not allow dual citizenship but offers the overseas citizen of India (OCI) which is a lifelong visa and there is no requirement to renew this yearly.
