What Happens to PIO Card after divorce?

Q: Dear Sir,

What happen with PIO card after divorce? Is it canceled or not.

Regards

Sweta

A: From what I understand, the PIO card has to be surrendered for cancellation in case of separation or divorce.

"If spouse of a citizen of India or a person of Indian origin is applying for PIO card, an undertaking from both will be required stating that in case if separation/ divorce the PIO card will be surrendered for cancellation;" (source: http://www.cgimelb.org/pio-card-services.html)

Number of Entries Allowed on OCI 'U' Visa

Q: I have a query regarding the number of entries allowed into India with an OCI. I am a Canadian Citizen and have been holding an OCI for the past four years. It has come to my attention that there may be a stipulation as to how many entries are allowed into India per year and that there must be a break of two months before you are allowed to re-enter India again. Could you please clarify this for me and verify if this information is correct or not.

Thanking you for your attention

Gita Khanna

A: There should be no limit to the number of entries allowed into India for OCI holders. If you look at your OCI 'U' visa sticker pasted on your passpost you will find that the number of entries specified are 'Multiple' No number is specified.

Some people may be confused because of changes announced recently regarding Indian tourist visa regulations that affect travellers who wish to enter India within two months of their last departure from the country. These new regulations were for tourist visa categories. Subsequently some of the earlier announcements were even relaxed to accomodate geunine tourists. You can read the news article here.

OCI Working in India

Q: Dear Mr. Chand,

Your web site is really very useful. I have some questions.

01. I am OCI holder and before I took overseas citizenship I was Indian Citizen and was doing Income Tax Practice ( not as lawyer) in India . Now I am back in India and want to open an office restart my old practice . Can I do that as an OCI holder ? Please guide me on this .

02. If I can this , than do I required some registration . Please guide with which authority .

Regards,

Rawal

A: If you are not applying to work for the Indian Government or run for political office you can do what ever work you like as long as it is legal and abides by the local, municipal, state and government laws applicable to the type of work you want to do.

I am not sure what sort of licensing is required to practice taxation in India for those wanting to provide taxation consultancy etc. However since you are already in India and have previously worked in the same field you should be able to find the current rules regarding the services you wish to provide from a lawyer, perhaps a taxation lawyer. Sorry I can't be of more help.

Hi Shiela, You can apply for and get a ration card. For proof of address if you are staying in India on rent then just get the landlord to issue you a letter certifying that you are living there. Other option is that if you have a bank account in India then get the bank to give you a printed bank statement with your address on it.

You also have the option of getting a PAN card in India very easily in two weeks or so. Pan is excellent for ID. Hope this helps
