I am Kenyan citizen but Indian origin
i was born in India i am planning to come back India for good but i wan't to know that if i want to come with my maid who is Kenya by born, than what is the procedure.

what kind of documents will required for the maid for life long.
As we are planning to come back with OCI visa.
So kindly advice.

A.  Taking a maid to India from abroad is something new. Normally its the other way around. If you are really serious you should check with the Indian consulate in Kenya. Perhaps you can also check with an immigration consultant.



APPLY FOR OCI AFTER RENOUNCING IT

A.  OCI application form includes a question: "Have you/any member of your family applied for OCI registration earlier? Yes/No - If yes, give details (Reference No., when and where applied and what was the outcome) Anyone who has renounced OCI and reapplies will I assume fill this part clearly stating they had renounced OCI in the past and the decision whether to grant OCI again will depend on the government authorities.

PAN CARD MANDATORY IN INDIA?.

Q. Dear Sir,

Your website is very informative but I still need more information about PAN. I want to apply for PAN as it is mandatory now in India. Before moving to US, we had property and bank accounts etc. there. Now if we apply for PAN, does it effect our previous assets in any way?

A. Pan card is mandatory in India only if you have taxable income that requires filling of tax in India. Pan card is not mandatory for Indians settled abroad who have no income to file in India.

Having a Pan number does not effect your property or assets in any way. Pan number is just a method of identity used by the income tax department in India. Something like your US social security number.

If you have a pan number and no income to declare then you do not have to file a income tax return in India. For further information on your personal tax status in India  you should perhaps consult a qualified  accountant.



SETTING UP FACTORY IN INDIA - WHERE TO GET INFORMATION?

Q. Hi there
I was wondering if you had any information about setting up a social enterprise in India. I am considering setting up a business (factory) in a disadvantaged part of India. I would like the principle aim of this business to be about providing opportunities to local people may be struggling to support their families. I would like to employ disadvantaged women and in addition to their wages, I would like the business to provide funding for their children’s education. This will be a partly commercial initiative, as I am hoping that the finished items made in the factory can be sold in the West for profit. Most of this profit will be ploughed back into the organization in order to fulfill its aims.

I noticed on your website that there are incentives for businesses hoping to set up in ‘backward areas’. This would be very beneficial for this organization. Do you know about any of the official procedures I would need to engage in to set up my proposed enterprise? It may be necessary that I set up the social enterprise in England under UK laws and set up an associate factory in India under IndiaR17;s tax laws.

A. Your idea of setting up a factory in a disadvantaged part of India is very commendable. While the ultimate aim of most business ventures is profit, I find some compassion in the wording of your email. I sincerely hope you pursue your project and make a success of it.
 

Every State Government in India offers advantages for setting up factories in their state. Selecting backward areas, has added financial advantages such as cheaper land or shed costs, tax holidays for a number of years, lower electricity charges, subsidized loan rates etc.

As a start you can check out the Ministry of Commerce & Industry website. This websites is supposed to provide information to investors about investment policies and procedures in India. Press releases related to investment policies are also on this website. They also have a chat facility which you may want to try if you need additional information. However this website in my opinion is not laid out very well and it takes time going around trying to find information. If you have an idea which part of India you would like to setup in, then you should check out the State Government website as some states have slightly better laid out websites than the Ministry of Commerce and Industry website.

REGISTRATION REQUIREMENT FOR STAY EXCEEDING 180 DAYS IN INDIA

Q. Please clarify  if my employment exceeds 180 days in India, should I register with FRRO/FRO and is it one-time registration?

A. Yes, if your stay is going to be over 180 days you should register. This is a simple procedure and a one time requirement. There is no fee for registration as long as you register before you complete 180 days in India.
Keep your copy of registration safely, as you will need it when you leave India.

You need to fill out the required registration form and provide the following documentation:
  • Original passport on which visa is endorsed.
  • Photocopy of the passport and initial visa.
  • Four photographs of the applicant
  • Details of residence in India
  • HIV test report from one of the WHO recognized Institutions from people in the age group 15 to 60 years, if the foreigner is visiting India on a visa for more than one year.
  • When filling in your registration form tick off multiple entry. In this way if you have to leave India for a short trip and return you will not have to register again. Top of Page

    CAN PIO HOLDER WORK IN INDIA

    I am born Indian and got Citizenship of another country in SE Asia and holding PIO, I want to know whether I can work in India now with PIO or does the company need to apply a work visa for me.

    A. PIO Card holders can work in India and do not need a employment visa for most types of work in the private sector.

    You cannot work for the Government and for some special types of work such as, research work or missionary activities.

    PIO cards have a validity of 15 years from the date of issue. However your foreign passport must also be valid during your stay in India.

    The length of time you can stay in India will depend on the validity of your passport and the PIO card.

    Of course if you are in India and if any of the above documents are going to expire you probably would have the option of renewing them in India, as long as you do it before their expiry date. After seven years in India PIO card holders, if they choose can apply for Citizenship of India.    


    PAN CARD LOST

            Q. Dear Sir,
    I am writing on behalf of Anita Cord since she doesn’t have a mail id.

    She had applied for PAN card online & requested for the delivery of the card in Kuwait for which she has paid necessary amount Rs. 771/-  The PAN Application status shows that the card has been dispatched on 13th March 2008, however the same has not been received by her till date.

    Can we know how the cards are sent –whether courier, registered post or ordinary post?

            A.  Please note that this website is not associated with the Government of India in any way.  I have lived abroad for 37 years and started this website after retiring as a hobby and my way of helping people with Nri related and immigration issues.

    The fee for processing PAN application is Rs.717.00[Application fee Rs.67 (Rs.60.00 + 12.24% service tax) + Dispatch Charges Rs. 650.00]. So I would assume that the tax department in India will not send out Pan Cards abroad by ordinary post as they charge Rs.650 for mailing cost.

    I can give you two suggestions:

    1. Check to see if you provided the correct address on your application when you applied for the Pan Card. Problems with misspelled words or wrong pin numbers can result in non delivery sometimes.

    2. You should contact the tax department in India and let them know that you have not received your Pan Card.

            MEDICAL INSURANCE IN INDIA FOR FOREIGNERS

    Can Foreign Nationals of Indian Origin (OCI) buy medical insurance from any of the major insurance companies in India (if they are permanently residing in India) ?

              A.  Medical insurance in India is offered by private insurance companies as India does not have a Government sponsored health insurance plan offered by countries like Canada.

    Anyone who can pay the premiums can buy medical insurance in India from the many medical insurance companies in India.

    When you shop around you will find most of the companies offering medical insurance in India are some how linked to foreign insurance companies.

    Shop around before you buy as plans offered by different companies while they may appear to be similar on the surface may be different when you check the fine print.

            MEDICAL LICENSING FOR FOREIGN DOCTORS IN INDIA

            Q. My name is Dr. S. Mathur. I writing to you as I want to settle down in Mumbai as I have been offered a job and plan to get married there soon. I am a Danish citizen and a PIO card holder. The Danish Government does not allow "dual citizenship".
     
    Would like to know how I can acquire a Maharashtra Medical License.

               A.  To acquire a medical license in India, one needs to contact the Medical Council of India. Their website should provide you with the information you require as well as appropriate forms.

    I am also including a link for the Maharashtra Medical Council for your convenience. Hope these links will save you time and help.

    You mention that the Danish Government does not allow dual citizenship, perhaps you are not aware, India also does not allow dual citizenship, however many people confuse Overseas Citizen of India (OCI) as being a form of dual citizenship which is not true. OCI in simple terms, is just a lifelong visa for India. As you already have a PIO card I doubt if you should have any problems.

    You say you have a job offer in India, your prospective employers should also be able to offer you assistance with your medical license.
